Diddy Files Motion to Overturn $100 Million Judgment, Claiming Lawsuit is Frivolous
Sean “Diddy” Combs is fighting a $100 million default judgment handed down earlier this week, which stems from a lawsuit by Derrick Lee Cardello-Smith. Cardello-Smith, a convicted rapist, alleges that during an encounter in 1997, Diddy spiked his drink and implied later that he had sexually assaulted him. Diddy’s team claims he was never properly served the lawsuit and maintains the allegations are fabricated, citing that the statute of limitations has long expired. Diddy’s lawyers are now requesting the judgment be set aside.
Diddy’s legal team asserts that Cardello-Smith, who they describe as having a history of filing frivolous lawsuits, fabricated the claims in an attempt to extort money from the music mogul. They state the claims are “implausible” and that even if there was some merit to them, the statute of limitations has long run out, given that the alleged incident occurred 17 years ago.
Cardello-Smith had initially been awarded the $100 million after Diddy failed to respond to the lawsuit filed in June.
